Dealing with divorce

A relationship breakdown can be one of the most stressful events in a person’s life, particularly if it is not amicable and there are children involved. The laws around property settlement in these types of situations can be quite complex. In addition, there have been changes to the Family Law Act 1975 (the Act) that can impact the final outcome of a property settlement.

Since the introduction of the Act in 1975, there is no longer any fault associated with divorce. The grounds for divorce are that the marriage has broken down irretrievably, which is evidenced by the parties to a marriage being separated for a period of not less than 12 months. Separation can involve one party leaving the home, but can also be a couple living separate and apart under the one roof as, quite often, economic circumstances necessitate a couple continuing to live together although the relationship has broken down.
